1. Agreement
By creating an account and using Cooc Gas, you agree to abide by these Terms & Conditions. If you disagree with any part of these Terms, do not use the Service.
2. Mandatory Account Registration
Users must open an account to access and use the Service. You agree to:
- Provide accurate and complete information
- Maintain confidentiality of login details
- Bear responsibility for all actions under your account
3. LPG Delivery Service
We facilitate the ordering, purchase, and delivery of LPG cylinders or refills to your chosen location. Service availability may vary by area and demand.
Delivery times provided are estimates, not guarantees.
4. Pricing and Payments
- All gas product prices and delivery fees are displayed within the platform
- Prices may change due to market fluctuations
- Orders are confirmed only after successful payment
- Failed payments may result in automatic cancellation
5. Safety and User Responsibility
You agree to:
- Provide safe access to your delivery location
- Ensure cylinders are in safe condition and certified within regulatory guidelines
- Follow all LPG safety instructions
We may refuse delivery if unsafe conditions are identified.
6. Order Acceptance and Risk
Risk of product loss passes to you once delivery is completed. Check your cylinder on delivery and report issues immediately.
7. Security Deposit and Forfeiture Policy
Security Deposit Requirement
Customers are required to pay a refundable security deposit for each gas cylinder provided under the exchange program. The deposit serves as a guarantee for the safe return and proper handling of the company’s cylinder(s).
Conditions for Refund
The security deposit will be fully refunded upon the return of the company’s cylinder in good, usable condition, subject to verification by the company.
Circumstances Leading to Forfeiture
The security deposit, in part or in full, may be forfeited under any of the following circumstances:
- Loss or Non-Return: The cylinder is not returned within the specified time frame or is permanently lost.
- Damage: The cylinder is returned damaged, altered, or tampered with, including dents, valve damage, unauthorized repainting, or structural compromise.
- Misuse: The cylinder has been used for purposes other than LPG storage or in violation of safety standards.
- Unauthorized Transfer: The customer sells, transfers, or lends the company’s cylinder to another party without prior authorization.
- Negligence or Fire Incident: The cylinder is destroyed due to negligence, improper handling, or involvement in a fire or explosion resulting from non-compliance with safety instructions.
- Breach of Agreement: The customer violates the terms of this agreement, including non-payment or fraudulent use of the service.
Assessment and Final Decision
The company reserves the right to inspect returned cylinders and determine, at its sole discretion and in good faith, the extent of any damage or breach warranting forfeiture.
No Interest Payable
The security deposit does not accrue interest and will be refunded (where applicable) within a reasonable period after the cylinder’s return and inspection.
8. Prohibited Uses
Users must not:
- Violate any Nigerian laws or gas handling regulations
- Misuse or tamper with equipment
- Attempt unauthorized access, hacking, or reverse engineering of the platform
- Provide fraudulent contact or address information
9. Intellectual Property
All branding, content, logos, and software belong to Cooc Gas or licensed owners. Copying or redistribution requires written consent.
10. Limitation of Liability
The Service is provided on an “as available” basis. To the fullest extent permitted under Nigerian law:
- We are not liable for indirect, incidental, or consequential damages
- Our maximum liability shall not exceed the total amount paid to us by you over the last 12 months
11. Indemnity
You agree to indemnify Cooc Gas and its operators against claims arising from:
- Breach of these Terms
- Misuse of LPG products
- Safety violations or negligence on your premises
12. Suspension or Termination
We may suspend or terminate your account if you:
- Breach these Terms
- Engage in fraudulent or unsafe activity
- Pose risk to staff or operations
Termination does not affect obligations incurred before the termination date.
13. Governing Law
These Terms are governed by the laws of the Federal Republic of Nigeria.
14. Dispute Resolution
Disputes shall be resolved through mediation or arbitration in Lagos, Nigeria before recourse to court.
15. Amendments
We may update these Terms. Continued enjoyment of the Service means you accept new conditions.
